You shall fully indemnify, defend, and hold harmless ICMC against any and all claims, demands, damages, costs or expenses (including reasonable attorneys’ fees and court costs) which ICMC may suffer or incur in connection with any claim, demand, action, lawsuit or other proceeding whatsoever by You or third party, arising directly or indirectly out of:

(b) any claim, loss or damage experienced from your use or attempted use of the Website, including any message or content you transmit through the Website;

(d) your infringement of any right of any third party.

5. IN NO EVENT WILL ICMC’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND YOUR USE OF THE WEBSITE, EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

7. Registration and Managing an Account

You are entitled to create an account on our Website in order to retain your details for future purchases. Your use of the Website through a registered user account is subject upon you agreeing to provide true, accurate, current and complete information about yourself.

While you have no legal obligation to provide any Personal Data or Information to Us, if you do not do so we will not be able to create your account or process your purchases through any such account.

10. Term and Termination

Unless set out otherwise by ICMC, these Terms shall come into effect and commence on the date that you open the Website and/or register to receive newsletters and notifications and shall lapse on the earlier of:

(a) the date you stop using our Website,

(b) the date of your attempt to circumvent any technical protection measures used in connection with the Website; or

Upon termination hereof, you must cease all use of the Website, and with such termination of your access or use not constituting a waiver of any rights or affect any other right or relief to which ICMC may be entitled at law or in equity.

Without limiting ICMC's statutory rights to terminate or ICMC’s other rights and remedies, ICMC is further authorized to suspend your access to our Website, at any time without notice, without incurring any liability for compensation in the event and with such suspension of your access or use not constituting a waiver of any rights or affect any other right or relief to which ICMC may be entitled at law or in equity.

ICMC may retain copies of Personal Data you provided to it as part of your use of the Website, where it has an overriding legal interest which requires it to preserve such copies, for example for the purpose of fulfilling legal obligations or to handle legal disputes or in order to comply with any order or writ issued by a competent court or governmental authority.

(b) Entire Agreement.

These Terms represent the entire agreement between the parties regarding the subject matter hereof and supersede any and all other previous agreements between the parties regarding the subject matter hereof. ICMC may assign its rights or obligations pursuant to these Terms. Users shall not assign any rights under these Terms and any attempted assignment shall be void. If any provision of these Terms shall be deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be interpreted to give maximum effect to its terms as permitted under law, and such invalidity or unenforceability shall not affect the validity or enforceability of any other part or provision of these Terms which shall remain in full force and effect.

(c) Jurisdiction.

These Terms shall be governed by the laws of Israel and any dispute, controversy or claim arising out of or relating to these Terms, will be referred solely to the competent courts of the District of Haifa, Israel.
